Términos Generales de Uso de la Aplicación

Estos términos y condiciones (en adelante denominados simplemente "Términos") se aplican a su uso de Nuestra Aplicación, "Ecomilhas".

Nuestra Aplicación, "Ecomilhas", es mantenida por ECOMILHAS TECNOLOGIA LTDA ("ECOMILHAS"), CNPJ No. 46.740.714/0001-37, correo electrónico: contato@ecomilhas.me, con sede en: Alameda Vicente Pinzón, No. 54, Vila Olímpia, código postal: 04547-130, São Paulo/SP, Brasil.

Al registrarse en la Aplicación "Ecomilhas" o de otro modo usarla, usted acepta estos Términos. Si no está de acuerdo con estos Términos, no debe usar la Aplicación "Ecomilhas" ni acceder a ningún Contenido.

TÉRMINOS Y NOMENCLATURA

"Nosotros", "Nuestro": Referencia a la Aplicación Ecomilhas o la Empresa ECOMILHAS.

"Aplicación Ecomilhas", "Aplicación", o simplemente "Ecomilhas": La Aplicación Ecomilhas.

ECOMILHAS: Se refiere a la empresa ECOMILHAS TECNOLOGIA LTDA.

ecomilhas: la moneda utilizada para canjear descuentos o dinero en efectivo dentro de la Aplicación.

Viaje(s): rutas viajadas por usuarios y mapeadas por la Aplicación.

Canje(s): pagos en efectivo o canjes de descuentos realizados por el usuario.

Billetera de Pago o Billetera: el lugar donde se consolidan todos los canjes realizados por el usuario.

Green Card: Suscripción de pago de ECOMILHAS.

Modo: medio de transporte.

CONDICIONES DE USO DE LA APLICACIÓN

Solo las personas mayores de 18 años (o la edad mínima equivalente en su país de origen) pueden registrarse en Nuestra Aplicación.

Además, debe tener la capacidad legal para celebrar un contrato vinculante con nosotros y no debe ser impedido de hacerlo por ninguna ley aplicable.

La Aplicación "Ecomilhas" también debe estar disponible para usar en su ubicación o dirección.

El incumplimiento de cualquiera de los requisitos de edad o elegibilidad anteriores significa que ECOMILHAS no puede registrarlo como usuario, y cualquier registro realizado fuera de estas reglas establecidas será nulo.

SERVICIOS PRESTADOS POR NOSOTROS

Disposiciones Generales del Servicio

Ofrecemos dos categorías de servicios a los usuarios: Ecomilhas por Descuentos (Freemium o gratuito) y Ecomilhas por Dinero (Suscripción Green Card de pago).

Independientemente del servicio elegido por el usuario, la premisa es la misma: usted, como usuario, completa viajes utilizando los modos de transporte aceptados por la Aplicación y gana ecomilhas — un tipo de moneda — por los kilómetros viajados. Estas ecomilhas, según el servicio elegido, pueden canjearse por descuentos en tiendas asociadas o por dinero en efectivo.

Al usar la Aplicación, independientemente del servicio elegido, está sujeto a todas las condiciones de aprobación y rechazo de viajes, valores de ecomilhas por kilómetro viajado, opciones de modo de transporte disponibles en la Aplicación, y todas las otras reglas comerciales establecidas en estos Términos de Uso y otra documentación relacionada proporcionada por ECOMILHAS.

A continuación se muestra una tabla de algoritmo que guía a los usuarios respecto a la aprobación o rechazo de sus viajes, que contiene todos los modos de transporte aceptados por la Aplicación, sujeto a restricciones en modos disponibles solo para usuarios empresariales:

El rechazo del viaje ocurrirá cuando cualquiera de los tres criterios se exceda en más del 100%, siendo el segundo criterio también activado cuando se exceda en más del 50% de los valores definidos por los algoritmos.

También puede haber problemas técnicos que interfieran con la presentación o impidan la aprobación del viaje. En cualquier caso, si no es posible validar un viaje realizado por el usuario debido a una ruta inexistente o un desvío total o parcial del recorrido, el viaje no puede ser aprobado, en cuyo caso ECOMILHAS estará exento de cualquier responsabilidad, una vez que se pruebe la inexistencia o desvío de la ruta.

Ecomilhas por Descuentos

Ofrecemos dos categorías de servicios a los usuarios. La primera se proporciona de forma gratuita y se conoce como "Ecomilhas por Descuentos". Bajo este servicio, una vez que se acumulan ecomilhas a través de presentaciones de viajes, el usuario puede canjearlas por descuentos en productos en nuestras tiendas asociadas.

No somos responsables de la entrega del descuento o su cumplimiento con la tienda asociada. Las reglas para usar el descuento se establecen por la propia tienda de terceros y deben ser seguidas por el usuario para evitar perder el beneficio.

Tampo co somos responsables de la calidad o cantidad de productos y servicios ofrecidos por tiendas asociadas; es completamente su responsabilidad entregar lo que se ofreció al usuario. De manera similar, es responsabilidad del usuario usar el beneficio dentro de los límites de tiempo especificados por la tienda asociada.

Suscripción Green Card o Ecomilhas por Dinero

El segundo servicio ofrecido es de pago y se conoce como "Green Card". Bajo este plan, el usuario paga una tarifa anual y obtiene acceso a canjes de "Ecomilhas por Dinero". Una vez que se acumulan ecomilhas a través de presentaciones de viajes, el usuario puede canjearlas por dinero en efectivo (a través de transferencias PIX), de acuerdo con las condiciones especificadas a continuación:

Solo se permite un canje por día.

Las transferencias PIX se procesan el día 10 de cada período mensual, con hasta 5 días hábiles para la liquidación bancaria. La clave PIX del usuario debe estar correctamente registrada en Nuestra Aplicación y con una institución bancaria.

Valores de Canje Disponibles

Los valores disponibles para canje dependen de las asociaciones de ECOMILHAS con empresas que tienen políticas de neutralización o reducción de emisiones de carbono. ECOMILHAS se reserva el derecho de poner estas opciones de canje disponibles de acuerdo con sus negociaciones y no será responsable de ninguna indisponibilidad de opciones de canje bajo ninguna circunstancia.

Cierre de Billetera

La billetera se cierra a la medianoche del día 10 de cada período mensual, lo que significa que cualquier canje realizado después de esta hora en esa fecha solo se transferirá en el próximo período mensual.

Períodos de Prueba

Ocasionalmente, podemos ofrecer una prueba de la suscripción Green Card sin costo o a una tarifa reducida. En este caso, usted acepta todas las condiciones ofrecidas en el momento en que se otorga la prueba, incluida la duración máxima de la prueba, que bajo ninguna circunstancia puede exceder un año de Green Card.

Valor de las Ecomilhas

El valor de cada ecomilha, que es la moneda de canje disponible en Nuestra Aplicación, es variable y depende de las tasas de negociación de créditos de carbono en el mercado. Actualmente, en la tienda, una ecomilha vale aproximadamente 10 centavos en promedio.

Para cada modo de transporte, se requiere un número diferente de kilómetros para ganar 1 (una) ecomilha. Cuando cambian los valores, los usuarios son notificados.

Los valores anteriores están redondeados y pueden variar ligeramente de un mes a otro. ECOMILHAS no es responsable de las fluctuaciones en el valor de las ecomilhas y se reserva la discrecionalidad total para establecer el precio en BRL de la moneda ecomilha, siempre que los usuarios sean notificados de cada cambio.

Green Card – Suscripción Empresarial

Los usuarios pueden tener su servicio de "Green Card" pagado por su empleador o una empresa asociada. En este caso, no somos responsables de los usuarios que forman parte de tales empresas pero no han sido beneficiados. Cualquier situación de este tipo debe ser manejada directamente entre el Usuario y su empresa contratante o asociada.

La empresa que tiene un contrato de Green Card con Ecomilhas es responsable de liberar la lista de usuarios que deben recibir el beneficio de la Suscripción Green Card.

Qualquier terminación o incumplimiento del contrato con la empresa puede resultar en la pérdida del beneficio de Green Card para los usuarios vinculados a esa empresa.

USO DE LA APLICACIÓN POR EL USUARIO

Registro de Usuario

To complete registration, the User must provide all required data in full. All information provided by the User must be accurate, truthful, and up to date so that we can, above all, stay in contact with you whenever necessary. In any case, the User may be held civilly and criminally liable for the truthfulness, accuracy, and authenticity of the information provided.

The user will provide their First Name, Last Name, Email, CPF (Brazilian tax ID), and Password to register on the Application.

The user may register on the Application through Social Login with the following platforms: Strava, Google, Apple, and Facebook. ECOMILHAS does not guarantee that third-party applications and devices will be compatible with Our Application.

The User must provide a valid email address through which all communications will be conducted. All communications sent to said address will be considered read by the user, who thus commits to regularly checking received messages and responding to them, if necessary, within a reasonable timeframe.

Upon confirmation of registration, the user will have a personal login and password, which must be used to access their account in the Application. This information must not be shared with third parties by the User, who assumes full responsibility for any use made of it. The user must immediately notify Us if they suspect any suspicious or unexpected activity on their account.

It is not permitted to assign, sell, rent, or transfer a User account in any way, as it is personal and non-transferable.

Whenever registration data is outdated, the User must update it using the data editing tools available on the Profile screen.

Each User may maintain only one account on Our Application.

Any User who violates any of the rules contained in this instrument will have their account(s) suspended and will be notified to provide justification. If no justification is provided within the designated timeframe or if the justification is not accepted, their registration will be deleted. In the case of duplicate accounts, the account without a Green Card subscription — or, if neither or both have a subscription, the account with the lower ecomilhas balance — will be deleted. If the ecomilhas balance is identical, the more recent account will be deleted.

Account Cancellation or Deletion

The user may, at any time and without need for justification, request the cancellation of their registration on the Application. Removal from the platform will be carried out as quickly as possible.

Whether in the case of a registration cancellation request or deletion due to non-compliance with the rules set forth herein, the User's personal data will be processed in accordance with our Privacy Policy.

Payments and Green Card Cancellation

ECOMILHAS may occasionally change the price of the Green Card Subscription and will communicate any price changes to you in advance with reasonable prior notice. Price changes will take effect at the beginning of the next subscription period following the date of the price change. Under applicable law, by continuing to use the Ecomilhas app after the price change takes effect, you will have accepted the new price. If you do not agree with a price change, you may reject it by canceling the applicable paid Subscription before the price change takes effect.

Your payment to Ecomilhas for use of the Green Card will be valid for a period of one year from the date of your subscription and will automatically expire at the end of the term, without automatic renewal.

If during the use of Green Card benefits you choose to cancel the subscription, you acknowledge that no amount paid or to be charged through any installment payment option will be refunded or canceled, as the payment is Annual, not Monthly.

Additional User Obligations

The User must use the Application's functionalities for purposes that do not violate the law, morality, or good customs. Specifically, the User must limit their use to the purposes for which the functionalities were created.

The User may not use crawlers, bots, or any automated computer programs, algorithms, equipment, or methodologies to access, copy, read, monitor, browse, fill out forms, or publish content on the Application.

The User may not use any automated or manual means or tools to access any content or information that has not been intentionally made available by Us, including information contained in sections of Our Application and information stored in or transmitted through the IT infrastructure used by Us, which includes equipment, networks, and servers.

The User may not violate or test the vulnerabilities of the Application's security mechanisms or the IT infrastructure used by Us.

The User may not use any content or information available on Our Application for the purpose of identifying other Users or other persons, unless the content or information has been lawfully disclosed for this purpose.

The User may not overload the IT infrastructure that maintains the Application with an excessive or unreasonable number of requests.

The User may not conceal their identity or the origin of their connection, nor impersonate another person. In this regard, among other possible violations, the User may not use any tools or mechanisms to manipulate or mask the origin of any message sent to Us or to Our IT infrastructure through Our Application or any of its functionalities.

Registered Users are responsible for any use made of their user accounts and must ensure that their access credentials (login and password) are not shared with third parties.

The User is responsible for ensuring the security of the electronic equipment and systems used to access the Application.

The User will be responsible for any content or information they may publish on Our Application.

The inclusion of pages that disseminate any type of illegal, violent, controversial, pornographic, xenophobic, discriminatory, or offensive information will not be authorized.

OUR RIGHTS AND OBLIGATIONS

Limitation, Interruption, or Suspension of the Application

We are committed to using all technical solutions at our disposal to ensure the Application can be accessed 24 hours a day, every day. However, We may, at any time, interrupt, limit, or suspend access to the Application or some of its pages or features in order to perform updates, modifications, corrections, or any other action we deem necessary to ensure the proper functioning of the Application.

For proper management, We may, at any time:

Suspend, interrupt, or limit access to all or part of the Application for a specific category or all Users;

Remove any information that may disrupt the Application's operation or that conflicts with Brazilian or international law;

Suspend the Application in order to perform updates and modifications.

External Links

Our Application may contain external links that redirect the User to other internet pages over which We have no control.

Despite the prior and regular verifications we perform, We disclaim any liability for the content found on pages and applications that may be accessed through these links.

Our Duties and Responsibilities

Although We adopt everything within Our reach to keep Our Application in full and correct operation, We shall be liable for defects or flaws found in the computer program that comprises Our Application that were caused by Us, provided there is proven damage.

Defects or problems arising from or as a result of the systems or equipment used by the User to access and use Our Application shall not be Our responsibility.

We are also liable, within the limits and terms of the law, for Our Content. However, We do not assume any responsibility for Third-Party Content.

We are not responsible for the uses that Users make of Our Application; they are personally and exclusively liable for their own actions.

We shall not be liable for any damages resulting from force majeure, acts of God, or those resulting from the actions of third parties.

Intellectual Property Rights over Computer Programs and Our Content

The computer programs that comprise the Application and Our Content available on the Application are Our property, unless We expressly state otherwise.

Our computer programs and Our Content that are protected by copyright may not be, in whole or in part, copied, reproduced, represented, adapted, or in any way altered, by any means and for any purpose, without Our prior, express, written authorization. In the event of violations of Our intellectual property rights, We reserve the right to take all appropriate judicial and extrajudicial measures.

Access to the Application does not grant the User any intellectual property rights related to elements of the Application.

PERSONAL DATA PROTECTION

We process Users' personal data in compliance with Federal Law No. 13,709/2018 (General Data Protection Law) and other applicable related regulations. More information on this subject can be found in our Privacy Policy.

In said Policy, we identify the personal data we process and provide information about how, why, and on what legal basis we do so, as well as about how Users can exercise their rights related to the protection of their personal data and how they can contact our Data Protection Officer.

Requests for amendment, correction, or deletion of personal data should be directed to Us in accordance with the provisions of that Policy.

USER SUPPORT SERVICE

For questions, suggestions, or problems with the use of the Application, the User may contact Our support service directly via email at: contato@ecomilhas.me or via WhatsApp at: +55 19 996496618. These User support services are available on the following days and hours: Monday through Friday, from 9 AM to 6 PM;

The User may also choose to send correspondence to the Application's headquarters address, provided at the beginning of this document.

SANCTIONS

Without prejudice to other applicable legal measures, We may, at any time, warn, suspend, and cancel the User's account:

Who fails to comply with any of the provisions contained in this instrument;

Who fails to fulfill their duties as a User;

Who commits fraudulent, illegal, or immoral acts;

Who provides any incorrect information;

Whose behavior constitutes or may result in offense or damage to a third party or to the Application itself.

AMENDMENTS

This version of the general terms and conditions of use was last updated in June 2023.

We reserve the right to modify, at any time, the application and services, as well as these rules, especially to adapt them to the Application's evolution, whether through the availability of new features or the removal or modification of existing ones.

The User will be explicitly notified in the event of changes to these terms by the Application itself, and may only continue using it by agreeing to the new version.

DO DIREITO APLICÁVEL E DO FORO

Para a solução das controvérsias decorrentes do presente instrumento, será aplicado integralmente o Direito brasileiro.

Os eventuais litígios deverão ser apresentados em um dos foros da comarca de São Paulo/SP.
